The use of our web site www.thepurplegiftcompany.com and the sale and purchase of goods from it are governed by our terms and conditions as set out below.

To the extent permitted by applicable law, The Purple Gift Company makes no warranty, express or implied, as to the accuracy, completeness or currency of the information contained in any of the materials on this web site. We reserve the right to change price and availability information without notice.
The Purple Gift Company shall not be liable to any person for any loss or damage that may arise from the use of any of the information contained in any of the materials on this website.
The company’s liability to the buyer shall at no time exceed the price of the goods supplied. The company shall be under no liability for any direct loss and/or expense or any indirect loss and/or expense suffered by the buyer or liability to third parties incurred by the buyer. The company shall be under no liability whatsoever for any loss or damage whether direct or indirect resulting from the supply of goods. The company shall be under no liability whatsoever for the quality and purpose of goods supplied to the buyer or to a third party.
We aim to give a fair representation of the product but all sizes are approximate and colours may vary slightly from those shown due to the limitations of Internet technology.
We shall sell to you and you shall purchase only those goods which you have set out in an order and which has been accepted by us. We reserve the right to refuse any order. Each such sale of goods will be subject to these conditions, which shall govern the contract to the exclusion of any other terms and conditions subject to which any order is made or purported to be made by you.
When you place an order on our website, you will receive an automatic email acknowledgement which will confirm all relevant details. This acknowledgement is not acceptance of your order and does not mean that a contract exists between us.
We will send you a confirmation email once the order and payment details have been verified and we have started processing your order. This indicates acceptance of your order, and hence a contract between us.
If we are unable to supply a particular product or unable to verify your payment details, we will email you at this stage to let you know. The completion of the contract between you and us will take place on the dispatch of the products ordered.
No order submitted by you shall be deemed to have been accepted by us unless and until confirmed by e-mail or in writing by us.
Orders are accepted at our sole discretion but are normally accepted if the goods are available, the order reflects current pricing,. Where goods are temporarily out of stock we will endeavour to contact you so that you may choose between a refund on the item, having it shipped when it is back in stock or selecting an alternative product.
The price of the goods shall be the price set out on the relevant page of this site. We reserve the right to change the prices set out on this site provided that if we accept an order from you the price for the goods will be the price set out in the relevant range at the time the order is placed.
In addition to the price of the goods you will be liable to pay our charges for transport & packaging as shown on the order form.
The total price is inclusive of any applicable value added tax.
Upon providing us with details of the payment card and submitting the order you shall confirm and undertake that the information contained within the order is true and accurate and that you are duly authorised to use the payment card and authorise us to deduct from the payment card account the full price of the goods and all other payments which may become due to us under the contract.
The deduction of monies from your payment card does not mean that we have accepted your order nor does it mean that a contract has been formed between us. In the event that we reject your order we will credit your payment card with the amount deducted.
Where goods are returned by you in accordance with your rights, and in accordance with our returns policy, we shall credit the payment card with the appropriate amount.
All orders must be paid for by credit or UK debit cards. We do not accept payment by cheque or postal order, and you cannot pay in instalments. We accept Visa (including Delta), Mastercard, Switch & Solo. We also accept Paypal payments. All prices are in pounds sterling (£).
Delivery of the goods shall be made by us or our carrier to the address for delivery shown in the order form. It is important that this address is accurate. If you choose our express courier option then you can stipulate where the parcel can be left if you are not there to sign for it otherwise all other parcels are sent by Royal Mail and we are unable to add specific delivery requirements. We aim to dispatch all goods within one working day (excluding Bank Holidays). If we fail to deliver the goods (or any part of) for any reason other than any cause beyond our reasonable control or your fault, and we are accordingly liable to you, our liability shall be limited to the price of the goods.
We hope that your order will be just what you wanted. But if you change your mind about our products you can return your order for any reason within 10 days for a refund.
Unless the goods are defective, damaged or not as specified on your order confirmation, you are responsible for the cost of returning the goods to The Purple Gift Company. We recommend that you use Recorded Delivery, as proof of shipping is not proof of receipt. If however the goods are faulty then the postage costs will be refunded by us.

We will take all reasonable care to keep all information connected with your order secure but we cannot be held liable for any loss that you may suffer if a third party obtains unauthorised access to any data, including credit and account details you provide when accessing or ordering from this web site, unless this is solely due to our negligence.
By disclosing information to us in using this web site, you consent to the collection, storage and processing of that information by the gifted penguin in the manner as set out in this policy.
